The OrderOnline service is provided by Magnus Heide AS (org. no. 932 761 173) (“we”, “us”). These terms apply to restaurants and other businesses (“the customer”, “you”) that create an account and use OrderOnline to publish digital menus. By creating an account, you agree to these terms.
1. About the service
OrderOnline is an online service that lets restaurants and similar businesses build and publish a digital menu, with categories, products, prices, allergen information and opening hours, available via a public link.
2. Account and user responsibility
You are responsible for ensuring that the information you provide when registering is accurate, and for keeping your login details confidential. You are responsible for all activity that occurs through your account. The account is personal and must not be shared with others.
3. Content you submit
You are solely responsible for the content you publish in your menu, including product names, descriptions, prices, images and allergen information. This applies in particular to allergen information being accurate and up to date — OrderOnline is only a tool for presenting the information you provide, and we are not responsible for errors or omissions in the content you publish.
You confirm that you hold the rights to the images and other material you upload, and that the content does not infringe third-party rights or applicable law.
4. Pricing and payment
New accounts get a free trial period, the length of which is stated at registration. After the trial period, the subscription is billed at the price shown in your backoffice at any given time, unless the account is marked as free. Payment is handled by our payment partner, Stripe.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period, and we do not refund periods already paid for unless otherwise required by law.
5. Intellectual property
OrderOnline, including its design, source code and trademarks, belongs to Magnus Heide AS. You retain all rights to the content you upload, but grant us a limited right to store and display that content as part of the service.
6. Availability and changes
We strive for high uptime but cannot guarantee that the service will be available without interruption. We may make changes to functionality and to these terms from time to time. In the event of material changes, we will notify you, for example by email or within the product.
7. Limitation of liability
The service is provided “as is”. To the extent permitted by law, Magnus Heide AS is not liable for indirect losses, lost profits or other consequential damages arising from use of the service, including errors in content the customer has published.
8. Termination and account suspension
You may close your account at any time. We reserve the right to suspend or terminate accounts that breach these terms or are used for unlawful purposes.
9. Privacy
We process personal data in accordance with applicable data protection law. Contact information linked to your account and your guests' use of the menu is processed solely to deliver the service.
Employees using the AI assistant (“Ask”) in the staff app: the questions they ask and the answers they get are stored with their name and the time. The restaurant's management can read them in the backoffice. The purpose is to see what employees are wondering about, so training and documents can be improved. They are deleted automatically after 12 months. Employees are told about this in the terms for employees (orderonline.no/terms/ansatt), but the restaurant is the data controller for its employees' data and must inform its employees of this, for example in the staff handbook.
10. Governing law
These terms are governed by Norwegian law. Disputes will be sought resolved amicably; if that is not possible, the matter falls under Norwegian courts, with the place of business of Magnus Heide AS as the legal venue.
